Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Anglerly service, including the anglerly.app website, related web applications, mobile applications, and any associated features (collectively, the 'Service') provided by SYNCWAVE LTD ('Company', 'we', 'us', or 'our'). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Important notice

Please read these Terms carefully. They include important information about your rights, obligations, automatic subscription renewal, and limitations of liability. If you are subscribing to a paid plan, please also read our Subscription Terms and Refund Policy.

1. About Us

SYNCWAVE LTD is a company registered in the United Kingdom with its registered office at 18th & 19th Floors, 100 Bishopsgate, London, United Kingdom, EC2N 4AG. You can contact us at support@anglerly.app for general inquiries or legal@anglerly.app for legal matters.

2. Eligibility

  1. You must be at least 18 years old to create an account and subscribe to a paid plan.
  2. By using the Service, you represent that you have the legal capacity to enter into a binding contract.
  3. The Service is intended for personal, non-commercial use. Commercial use requires a separate written agreement.

3. Accounts

  1. To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration.
  2. You are responsible for safeguarding your account credentials. You must notify us immediately at support@anglerly.app if you suspect unauthorized access.
  3. You are responsible for all activity that occurs under your account.
  4. We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

  1. Anglerly provides fishing-related information including solunar forecasts, tide predictions, weather data, and a personal catch journal.
  2. The Service is provided for informational and recreational purposes only. It is not a substitute for professional judgment, official maritime or weather advisories, or local fishing regulations.
  3. We do not guarantee any specific fishing outcomes. Forecasts are probabilistic and depend on third-party data sources whose accuracy may vary.
  4. Features and content may change, be added, or removed at our discretion.

5. Subscriptions and Payments

  1. Certain features of the Service require a paid subscription. Available plans and current pricing are displayed on anglerly.app/#pricing.
  2. Available plans as of the effective date:
    • Try It Out: $4.99 for the first 7 days, then automatically converts to a monthly subscription at $28.80 per month unless cancelled before the end of the introductory period
    • Weekly: $8.99 per week, auto-renewing weekly
    • Monthly: $19.99 per month, auto-renewing monthly
    • Yearly: $49.99 per year, auto-renewing yearly
  3. All prices are in US Dollars (USD) and exclude applicable taxes, which may be added at checkout based on your billing location.
  4. Subscriptions renew automatically at the end of each billing cycle at the then-current rate, unless cancelled.

  6. Refund eligibility and procedure are described in our Refund Policy.

6. Cancellation

  1. You can cancel your subscription at any time from your account dashboard.
  2. Cancellation stops future renewals. You retain access to paid features until the end of your current billing period.
  3. Cancellation does not, by itself, entitle you to a refund of amounts already paid. See our Refund Policy for refund terms.

7. User Content

  1. The Service allows you to upload content including photos, catch logs, notes, and location data ("User Content").
  2. You retain ownership of your User Content.
  3. By uploading User Content, you grant SYNCWAVE LTD a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit your User Content solely for the purpose of operating and improving the Service.
  4. You represent that you have all necessary rights to upload your User Content and that it does not infringe any third-party rights or violate any law.
  5. Optional community sharing features require explicit action on your part. Nothing is shared publicly without your consent.

8. Acceptable Use

You agree not to:

  1. Use the Service for any unlawful purpose or in violation of any applicable regulations
  2. Reverse engineer, decompile, or attempt to extract the source code of the Service
  3. Upload malicious code, spam, harassing material, or content that infringes intellectual property
  4. Use automated tools to scrape, harvest, or extract data from the Service
  5. Misrepresent your identity or impersonate others
  6. Interfere with the security or proper functioning of the Service
  7. Resell, sublicense, or commercially exploit access to the Service without our written permission

We may suspend or terminate accounts that violate these rules.

9. Intellectual Property

  1. The Service, including its software, design, branding, text, graphics, and trademarks, is owned by SYNCWAVE LTD or its licensors and protected by intellectual property laws.
  2. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes during your active subscription.
  3. All rights not expressly granted are reserved.

10. Third-Party Data and Services

The Service relies on third-party data sources for weather, tide, and astronomical information, and on third-party providers for payment processing, hosting, and analytics. We are not responsible for the accuracy, availability, or actions of third parties. Your use of third-party services may be subject to their own terms.

11. Disclaimers

  1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  2. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate or complete.
  3. Fishing forecasts are estimates based on available data. You assume all risk for decisions made based on information from the Service, including decisions regarding personal safety, navigation, and compliance with local regulations.
  4. You are responsible for following all applicable fishing laws, licensing requirements, catch limits, and safety practices in your jurisdiction.

12. Limitation of Liability

  1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNCWAVE LTD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
  2. OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED US DOLLARS ($100).
  3. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not fully apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless SYNCWAVE LTD and its affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.

14. Termination

  1. You may stop using the Service at any time and cancel your subscription from your account.
  2. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms.
  3. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

  1. These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
  2. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer law grants you the right to bring claims in your country of residence.
  3. Before initiating formal proceedings, you agree to first contact us at legal@anglerly.app and attempt to resolve the dispute in good faith for at least 30 days.

17. Miscellaneous

  1. If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force.
  2. Our failure to enforce any right does not constitute a waiver.
  3. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
  4. These Terms, together with our Privacy Policy, Refund Policy, Subscription Terms, and any other policies referenced, constitute the entire agreement between you and SYNCWAVE LTD regarding the Service.
